Behavior Advantage is designed for use in educational settings and may process student information as part of our Services. We host our platform on Amazon Web Services (AWS), which provides industry-leading security and compliance. Our systems are designed to align with the requirements of the Family Educational Rights and Privacy Act (FERPA) and, where applicable, the Health Insurance Portability and Accountability Act (HIPAA).

All student data entered into the Behavior Advantage platform remains under the ownership and control of the subscribing district or organization. Behavior Advantage does not sell or share student data and uses it only to provide and improve our Services. The subscribing district or organization is responsible for ensuring appropriate use and access of student data within the platform.

Types of Student Information We May Process (if submitted by the Customer):

  • Full name
  • Date of birth
  • School of attendance
  • Gender
  • Age

Our Commitment:

  • We do not sell or share student PII (“education records” under FERPA) outside the subscribing district.
  • Access to student data is limited to authorized users designated by the subscribing district.
  • We implement appropriate safeguards to protect this information.
  • Student data is retained only as long as the district maintains an active account, unless otherwise required by law.

We may share personal information:

  • With service providers under strict contractual obligations
  • In the event of business transfers (e.g., mergers or acquisitions)
  • Only when necessary and legally permitted

Student data is retained only as long as the subscribing district maintains an active account, unless otherwise required by law or agreed upon in writing.

Student Data Rights
Because Behavior Advantage operates as a school service provider, requests related to student information (also known as “education records” under FERPA) must be directed to the student’s school or district. Behavior Advantage cannot respond directly to parent or student requests regarding education records, but we will fully support and cooperate with schools or districts in fulfilling such requests.
